General Conditions

art. 1 General

These general terms and conditions apply to all transactions and agreements concluded with Alina Hoyo Nail Artist, General Partnership (VOF), having its registered office at Monnikenwerve 43 bus 1, 8000 Bruges, Belgium.

By placing an order, whether through the website or by any other means, the customer expressly agrees to these general terms and conditions. All transactions with Alina Hoyo Nail Artist are subject to these conditions.

All agreements shall be governed by and interpreted in accordance with Belgian law. Any disputes shall fall under the exclusive jurisdiction of the courts of Bruges. Nothing in these general terms and conditions shall affect the statutory rights of the consumer.

“The company”, “we” or “us” refers to Alina Hoyo Nail Artist. “The customer” or “you” refers to any natural or legal person who purchases or intends to purchase goods or services from the company. Any reference to the website refers to all URLs owned by Alina Hoyo Nail Artist.

art. 2 Prices

All prices are displayed in euros and are, by default, exclusive of VAT, unless expressly stated otherwise. If VAT applies, it must be paid by the customer.

All prices may be changed at any time without prior notice. The price applicable at the time of ordering is the price that applies to that order.

art. 3 Orders

The customer may place an order via the website www.alinahoyo.com by adding a product to the shopping cart and completing the checkout procedure. During this process, contact and billing details are entered or verified, after which payment is made.

After correctly completing all required information, the customer will be shown an overview of the order. By confirming the order, the sales agreement is concluded definitively. The agreement is concluded in the language of the website through which the order is placed.

Online payments are processed via a secure server. Credit and debit card payments are subject to validation checks and approval by the card issuer. Alina Hoyo Nail Artist cannot be held liable for delays or non-delivery resulting from a failed or incomplete payment.

Orders by bank transfer are possible. In that case, the order will be reserved for a maximum of three working days, unless otherwise agreed. If payment is not received within this period, the reservation will automatically expire. Invoicing takes place upon delivery and must be paid within the period stated on the invoice.

Minors under the age of 18 may not place an order without the consent of a parent or legal guardian.

art. 4 Delivery

Ordered products will be delivered as quickly as possible according to the chosen delivery method and subject to availability. Delivery costs may be changed at any time without prior notice.

The maximum delivery period is 30 days, calculated from the day following the placement of the order. If delivery within this period is not possible, the customer will be informed and advised of the expected delivery date. If delivery remains impossible within this period, the customer has the right to cancel the order and any amount already paid will be refunded in full.

If goods are damaged during transport, do not correspond with the delivery note, or do not match the order, the customer must report this within 14 calendar days of receipt. Failing such notification, the delivery shall be deemed accepted.

The liability of Alina Hoyo Nail Artist for late delivery or non-delivery by the carrier is limited to the value of the undelivered goods.

art. 5 Returns and Exchanges

If the customer wishes to return or exchange an item, this must be done within 14 calendar days of receipt, in its original packaging, unused and with labels attached, together with a copy of the delivery note.

If a product is received damaged, this must be reported within 24 hours of delivery. Initially, an attempt will be made to resolve the issue remotely using photos or videos. If this is insufficient, the product must be returned. In that case, a return label will be provided. Upon receipt and inspection, it will be determined whether a refund or replacement is justified.

art. 6 Warranty

All products are covered by a 24-month warranty from the date of order, unless otherwise stated. This warranty covers manufacturing and material defects. Damage caused by improper use, negligence, or accidents is not covered by the warranty.

For warranty claims, the customer must contact the company. If necessary, the product should be returned to:

Return shipping costs under warranty are borne by the customer, unless otherwise agreed.

art. 7 Products

All products are sold subject to availability. Colors and images are displayed as accurately as possible, but colors may vary due to technical limitations of screens.

art. 8 Distance Selling Regulations – Right of Withdrawal

The consumer has the right to withdraw from an order within 14 calendar days of delivery, provided the goods are unused. This right does not apply to personalized products, perishable goods, or sealed products whose seal has been broken.

In the event of withdrawal, the customer will receive a refund of the amount paid, including standard delivery costs, within 14 days of notification of withdrawal using the same payment method. The company may withhold reimbursement until the goods have been received or proof of return has been provided.

Different conditions apply to business customers and customers outside the EU, whereby only the value of the returned goods will be credited and any additional costs remain the responsibility of the customer.

art. 9 Force Majeure

Alina Hoyo Nail Artist shall not be liable for failure to perform its obligations due to force majeure, including but not limited to strikes, fire, flooding, transport issues, pandemics, or government measures. In such cases, liability remains limited to the value of goods already delivered.

All information on the website and in printed materials is provided for informational purposes only and cannot be considered binding advice or a guarantee. Content is updated regularly.

art. 11 Prices and Printing Errors

Despite careful control, Alina Hoyo Nail Artist cannot be held liable for printing errors or inaccuracies. We reserve the right to change prices and specifications without prior notice.

art. 12 Ownership of Goods

All delivered goods remain the property of Alina Hoyo Nail Artist until full payment has been received.

art. 13 Questions or Complaints

Questions or complaints may be directed to info@alinahoyo.com. We aim to handle complaints within 5 working days. Disputes may also be submitted through the European ODR platform: http://ec.europa.eu/odr.

art. 14 Security

We take all reasonable measures to ensure transactions are carried out securely and use SSL encryption to protect personal data and payments.
